Terms of Service

By accessing or using Fira Smart Desk ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

Fira Smart Desk provides:

• AI-generated trading signals for forex and commodity markets (primarily XAU/USD).
• Fundamental analysis powered by multiple AI engines.
• Trading journal and performance tracking tools.
• Real-time market data, prediction market insights, and economic calendar.
• Telegram-based signal alert notifications.
• Trading calculators and risk management tools.

• You must be at least 18 years old to use the Service.
• You must have the legal capacity to enter into a binding agreement.
• You are responsible for ensuring that your use of the Service complies with the laws and regulations of your jurisdiction.
• Trading in financial markets may be restricted or prohibited in certain jurisdictions. It is your responsibility to verify legality.

• Registration is by invitation only. You must have a valid invite code to create an account.
• You must provide accurate and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must notify us immediately of any unauthorised use of your account.
• One account per person. Multiple accounts may be terminated without notice.

• Certain features require a paid Premium subscription.
• Payments are processed securely by Stripe. We do not store your payment card details.
• Subscription prices are displayed in Malaysian Ringgit (MYR) or US Dollars (USD) as indicated.
• Subscriptions renew automatically unless cancelled before the renewal date.
• Refund policy: No refunds for partial subscription periods. Contact us for exceptional circumstances.
• We reserve the right to change subscription prices with 30 days' notice.

You agree NOT to:

• Use the Service for any unlawful purpose.
• Attempt to gain unauthorised access to any part of the Service.
• Interfere with or disrupt the Service or its infrastructure.
• Use automated scripts, bots, or scrapers to access the Service (except via our official API).
• Redistribute, resell, or share your account or signal data commercially without permission.
• Impersonate another person or entity.
• Upload malicious content or attempt to exploit vulnerabilities.

• The Service, including all content, features, AI algorithms, and design, is owned by Fira Smart Desk.
• You are granted a limited, non-exclusive, non-transferable licence to use the Service for personal trading purposes.
• You may not copy, modify, distribute, or reverse-engineer any part of the Service.
• Trading signals and AI analysis are proprietary. Sharing signals publicly (e.g., social media, competing services) without permission is prohibited.

• Win rates and performance statistics displayed on the platform are based on historical data and calculated automatically.
• We strive for accuracy but do not guarantee the accuracy, completeness, or timeliness of any signal or analysis.
• Market conditions can change rapidly. Signals may become invalid due to unexpected events.
• The Macro Outlook grading system (A+ to C-) is an advisory indicator, not a guarantee of outcome.
• Always use proper risk management, including stop-loss orders, regardless of signal confidence.

The Service integrates with third-party providers. Your use of these services is subject to their respective terms:

• Stripe — Payment processing (Stripe Terms)
• Telegram — Alert notifications (Telegram Terms)
• Twelve Data — Market data provider
• Polymarket — Prediction market data
• OpenAI, Google, Anthropic — AI analysis providers

We are not responsible for the availability, accuracy, or policies of third-party services.

You agree to indemnify and hold harmless Fira Smart Desk, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service.
• Your trading decisions and their outcomes.
• Your violation of these Terms.
• Your violation of any applicable law or regulation.

• You may terminate your account at any time by contacting us.
• We may suspend or terminate your account for violation of these Terms, abuse, or at our discretion.
• Upon termination, your right to use the Service ceases immediately.
• Data deletion follows our Privacy Policy retention schedule.

These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
